The mobile Applications, the Websites and in general all the Services provided by the FUNDACIÓN AMEN DIGITAL, will hereinafter referred to as "Services".

Please read these Terms and Conditions and the Privacy Policy before using the Services. Anyone who is 18 years of age or older and who is not limited by any medical condition or applicable law of their place of residence may use the Services. The person capable of forming a binding contract, who meets these requirements and agrees with these Terms and Conditions and the Privacy Policy ill hereinafter be called "User". The FUNDACIÓN AMEN DIGITAL, will hereinafter referred to as "AMEN".

1. Overview

Services are of a social nature, free of charge, aime at people who wish to communicate with Catholic Consecrated Religious to present their thanks, prayers and concerns, among others. Also, it is addressed to Catholic Consecrated Religious who wish to be more in touch with people who seek God everywhere, even in the digital world. Services do not replace the Sacred Sacrament of Confession which has the character of a personal encounter with the consecrated Priest.

AMEN encourages all users to join, actively participate and get involved in the Holy Sacraments at their catholic parishes and communities. AMEN promotes a new style of apostolate and evangelization. User will be able to make inquiries, find churches and Information about them, as well as daily messages, the Gospel of the day, the Saint of each day and different prayers.

AMEN Services are provided tools available to anyone who has access to a mobile device or desktop. It aims to bring the Catholic Church closer to those who are already involved and those who seek answers in the digital world or are in countries with difficult conditions or exclusion due to their religious status. Lastly, it also intends to extend the word of God.

AMEN is a family initiative that was possible to create thanks to the support of many Consecrated Religious friends, including Franciscans, Diocesans, Marianists, Missioners, Paulists, Benedictines, the Little Sisters of St. Peter Claver and the Franciscan Missionary Sisters of Maria Auxiliadora. The terms and conditions that regulate the Services are provided in the Law of electronic commerce and User will be able to communicate with the owner by the following email: support@amenapps.com. We would love to hear from you.Any feedback from User is deemed to be non-confidential and non-proprietary.

AMEN shall be free to use such Information on an unrestricted basis, without any compensation to User or any third party. In the name of God, AMEN.

2. Acceptance of Terms and Conditions

The access and use of the Services, implies the acceptance of the terms and conditions that are presented here, without any reservation. Consequently, it is the responsibility of all Users to properly use the Services, a complete reading of the current terms and conditions and compliance with any instructions that could be established at any time as a complement to these terms and conditions. User understands and accepts receiving notifications, alerts, publicity material and in general, Information that it is offered by the AMEN Services to achieve its goals. Subject to User compliance with these Terms and conditions, AMEN grants User a limited non-exclusive, non-transferable, non-sub-licensable license to download and install a copy of the mobile Applications, as well as to access it through its web version on the Websites, on a mobile device or computer that User own or control and to run such copy of the mobile Applications solely for User own personal non-commercial purposes.

AMEN reserves all rights in and to the mobile Applications and Websites not expressly granted to User under these Terms.

3. Conditions of access and use

The use of the Services obeys in the first instance to the Christianity, the good faith, honor, moral and the good virtues of the User. The mobile Applications and the Websites are free to use, however AMEN may condition the access or use of certain areas, functionalities, features or Services.

AMEN does not control nor it is responsible for messages, comments, information, files, images, videos or any other Content, hereinafter referred to as "AMEN", that User enters, uploads, reviews or shares in the mobile Applications or the Websites. AMEN does not systematically review User’s submitted Content. AMEN does not necessarily endorse any opinion contained in such material. AMEN makes no warranties or representations, express or implied, about the Content, including as to its legality, veracity or accuracy. Any Information, Content, scope and consequences are the sole and exclusive responsibility of the Users who acts at their own risk.

If User does not want to accept responsibility in accordance with these terms and conditions, then User must not agree these terms and conditions and User must not use the mobile Applications, the Websites, or the AMEN Services. With or without giving User any prior notice, AMEN reserves the right, in its sole discretion, to refuse, block, remove or edit the Content of User and delete, restrict, suspend or terminate the access to User´ account if the account or the Content associated with it breaches this section or it is, in our assessment, discriminating, racist, sexually oriented, unethical, threatening, offensive, harassing or otherwise violates applicable laws or regulations.

All offensive, disrespectful, indecent, aggressive, obscene and / or defamatory material may be reported and automatically without prior notice or justification, the User will be denied access to the Websites and the mobile Applications.

User declares and warrants to AMEN that material or Content is not illegal, obscene, defamatory, threatening, pornographic, harassing, hateful, racially or ethnically offensive, and does not encourage conduct that would be considered a criminal offense, and does not give rise to civil liability, violate any law, or is otherwise deemed inappropriate. Users must not directly or indirectly send comments, reports or any form of communication that is considered harassing or that violate the laws applicable to the right to privacy, image and / or honor. In the mobile Applications or the Websites there may be available links to other sites whose Information is not the direct or indirectly responsibility of AMEN. AMEN promotes dialogue with the Catholic Church and its Religious people, reading the Holy Gospel, meditation, prayer and learning in the virtues of the Saints.

AMEN allows Users communicate with other Users (Diocesans Priests and Catholic Consecrated Religious). AMEN will store and process communications and related Information. AMEN will then use Information about whom Users have communicated with and when to better understand the use of the mobile Applications. AMEN shares the Content of messages with other Diocesans Priests and Consecrated Religious near to them or randomly. At all times Users may delete their messages however receivers’ Users (Users that receive messages) will have their own copy until they delete them too. Messages may not be encrypted, and AMEN therefore advises Users not to include any confidential Information on them. AMEN recommends care in deciding which Information to provide. User agrees not to submit any Content or Information with expectation of privacy.

4. User responsibility

Users are solely responsible for ensuring the veracity, accuracy and authenticity of the Information they provide in the registration and carrying out any necessary updates. User will have the freedom to register and use a name to identify themselves in their profile. AMEN will try the best to verify or confirm the registered Information of Priests and Consecrated Religious with the aim of enabling them in the mobile Applications so that they can proceed to respond or to communicate with Users. Any fraud, abuse, damage, injury or harm caused by any User pretending to be Priest or Consecrated Religious will be denounced and consequently all expenses, fees, losses, and costs, arising out of it will be entirely responsibility of the User.

It’s important that User provides us with accurate, complete and up-to-date Information for their Account and User agrees to update such Information, as needed, to keep it accurate, complete and up-to-date. If User does not, AMEN, at its sole discretion, might suspend or terminate User Account. The data and Information provided by the User will have the corresponding automated treatment, it may be used and shared by AMEN with its commercial allies always in accordance with the Data Protection Law and the current HABEAS DATA rules. Emails, push notification, alerts, newsletter or Information containing own operational Information may be sent by AMEN.

AMEN uses User personal Information to communicate with, respond inquires, provide Information that may be of interest of and updates about latest developments or features. Users may object to the processing of personal Information for direct marketing purposes and may withdraw any consent provided at any time and free of charge by emailing to support@amenapps.com User will be able to use the Content and AMEN Services solely and exclusively as own and personal use, as tools of reading, reflection and learning.

User must not use AMEN, directly or indirectly, to involve commercial exploitation or any other type of activity that is considered illegal or fraudulent in the current legislation. Consequently, Users will be liable for and will be responsible for any unlawful or harmful actions against third parties, damages and damages, of any kind, that may suffer, directly or indirectly, AMEN, Users and / or any third party that feels affected, harmed or limited. User will have at his own risk and responsibility any activity that is carried out with or through his profile and must be responsible for damages caused as a result of the loss of the mobile device or the use without the consent of the mobile Applications by others people. The User will respect the copyright and intellectual property rights of AMEN and third parties and may not disable, damage, overload or damage, directly or indirectly, AMEN equipment or systems. User is fully responsible for the Information that provide through and in the Services. AMEN is not responsible for the Content that Users post, share, submit or upload. By submitting, sharing or uploading material or Content, hereby grant AMEN an irrevocable, perpetual, non-exclusive, royalty-free, worldwide license to use, telecast, copy, perform, display, edit, distribute and otherwise exploit the material or Content, with or without attribution, and without the requirement of any permission from or economical retribution to User or to any other person or entity, in any manner.

AMEN is entitled to identify User to third parties who claim that their rights have been infringed by User’s Content, material or Information. AMEN requires certain Information from User to provide, personalized, enhance or improve its Services. AMEN respects User´s privacy and want to be clear about the data collected. When Users choose to share their personal Information, AMEN collects and uses it to conduct business analytics, operate, to authenticate accounts, improve safety and prevent spam, fraud or abuse. AMEN collects and uses Information from Users to operate such as IP address, precise location, name or pseudonym, email address, phone number, address, sign in credentials, language and others controlled by Users on settings/profile. Location is important because it will allow Users to send messages to nearest Diocesan Priest or Consecrated Religious, to see nearest churches and messages of the day and to provide Users with notifications, features and marketing. User can access to AMEN with their own profile on Facebook. When Users use this option AMEN automatically collects selected Information about them such as name, Username, email and/or photo depending on what Information Users have made available on their privacy settings on Facebook. AMEN may preserve, use, or disclose User’s personal data if it is reasonably necessary to perform these terms, operate, solve technical issues or because it’s required by law.

AMEN may share personal Information with Services providers and other third parties that perform Services on behalf of AMEN. In case of sale, joint venture, assignment, merging, acquisition or reorganization User’s personal Information may be sold or transferred as part of the transaction. There may be several reasons which justify AMEN processing Users’ personal Information. User can access, modify, delete or restrict any Content of personal data at any time. AMEN keeps Users’ personal Information for as long as they have an account or as needed to provide its Services. AMEN processing personal Information is based on consent by accepting this terms and conditions. Users have the right to object to the processing of its personal Information and may freely withdraw or revoke any consent provided, as well as delete their account at any time and free of charge upon request by emailing to: support@amenapps.com. In some cases, even if Users close their account, AMEN may retain certain Information in an anonymized or aggregated form.

Users that do not agree must not use the Websites or the mobile Applications or any of the AMEN Services. All Information User has shared through AMEN, except by the messages sent to Diocesan and Consecrated Religious, may be sent by AMEN upon request to support@amenapps.com AMEN uses a variety of security technologies and procedures designed to help prevent unauthorized disclosure of Users’ personal collected or received Information. However, since the internet is not a 100% secure environment, AMEN cannot ensure or guarantee the security of Users’ personal Information.

Users must never use the AMEN’s Services while driving, operating heavy machinery, or performing other tasks that require attention and concentration.

5. Donations and renewal policy

AMEN offers for free certain enhanced features of the mobile Applications, websites and services to people who donate every year, hereinafter called the “Subscription”. The amount applicable for the gift or Subscription is determined by AMEN at its own discretion; it is an annual and really small and symbolic value. A description of features associated with Subscriptions is available on the Websites. User agrees to donate the applicable fees and agree to supply additional Information relevant to the subscription, donation or transaction, such as full name, credit card number, credit card’s owner full name and Information, the expiration date of the credit card and address for billing.

Users declare and warrant that they have the legal right to use all donation method(s) and that the source or origin of the resources they are going to donate is legal and does not come from criminal or illegal activities. User authorizes AMEN to provide transaction information to third party Service providers to complete the Subscription, donation or Transaction. AMEN reserves the right, in its sole discretion, to take steps to verify Users’ identity in connection with the subscription, donation or transaction. User’s subscription is not binding on AMEN.

The User donates from the heart so that AMEN continues to improve its Services. AMEN reserves the right to not process or to cancel User transaction in certain circumstances such as declined credit card, suspect of fraud, or in its sole discretion. AMEN may at any time and from time to time, in its sole discretion, change the applicable fees and charges, or add new fees and charges, in relation to any of the Services. AMEN will notify in advance of such changes becoming effective. Changes to the subscription will not apply retroactively and will only apply for Subscription renewals. Users that do not agree with the change must not renew and cancel their donation. This ministry operates by faith, providing ministry in church services, prayers, bible and books readings, devotionals and spiritual counselling all at no charge. God is always faithful to provide by dealing with the right person, at the right time to give so that they need is met with surplus. User’s donation is a response to AMEN’s faith and prayers and thanks to it, AMEN can continue working, improving, innovating and leading more people to meet the Lord. It is also an investment in God’s eternal kingdom for which you will receive reward. Please take into consideration that all donations are non-refundable and non-transferable.

Renewal Policy

Did you know that AMEN is a non-profit organization? AMEN's goal is missionary. AMEN was not conceive, is not and will not make a business of it. AMEN’s purpose is to evangelize, cause more encountering with our Lord, more conversion, more prayer and bring peace and joy to everyone's life. Each subscription renews automatically for an additional period equal in length to the expiring subscription term until Users cancel it. Users must cancel the Subscription before it renews to avoid the donation for the next Subscription period. User can cancel the renewal at any time by contacting AMEN by email at support@amenapps.com. User will not receive a refund for the fees already donated for their current subscription period and they will continue to receive the Services ordered until the end of User current Subscription period. Subscriptions Automatically Renew Until User Cancel the subscription.

Gifts and Promotions

AMEN reserves the right, in its sole discretion, to offer gifts, discounts or free subscriptions. The availability of them is not guaranteed. Gifts, discounts or subscriptions cannot be redeemed for cash, resold or combined with any other offer. All gifts and promotions, including free subscriptions, will apply to the initial period of the gift or promotion, and any renewals will be at the conditions in effect at the time of renewal.

AMEN is not responsible for offers, discounts, gifts or subscription that have been lost, stolen or used without permission.

6. Copyright and industrial property rights

The mobile Applications, Websites, domains www.amenapps.com, www.eamen.co, codes, web administrator, tools, options, distinctive signs, graphic design, logos, trademarks and technical and operational development are the intellectual property of AMEN. The source code and in general any conceptual and intellectual creation existing and proper to the applications and the Websites are protected as copyright by the legislation on intellectual property. Exemption of protection that Information whose ownership is not of AMEN, are free access or have the character of public domain. AMEN is not responsible for the links that may be linked or displayed on the Websites, or the Contents accessed; However, AMEN will do its best and is committed to ensuring that the linked Websites are of Christian Content, with Christian principles and values. User is prohibited to commercialize, reproduce, modify, copy or redistribute both the Content or the Information stored in his web administrator, Websites, server or mobile Applications. The User cannot decompile, disassemble, reserve engineer or attempt to discover the source codes found in the mobile Applications. User will not attempt to probe, scan, or test the vulnerability of AMEN Services, its system, platforms, codes or network and will not attempt to breach any security or authentication measures. User is prohibited to interfere with, or attempt to interfere with, the access of any other User, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services. 7. Cancellation and suspension of Service.

The User understands, recognizes and accepts that AMEN will cancel or eliminate access to the mobile Applications, when the User violates the terms, policies and conditions of use. The cancellation will be done without prior notice, justification or notification and will be without right to any compensation.

AMEN reserves the right at its sole discretion, to suspend, modify, add or remove portions of the terms and conditions or terminate the provision of its Services or Contents, at any time by sending or posting the amended Terms of Service on AMEN sites or within the Services. User understands and agrees that they are solely responsible for their use of the Services.

AMEN is not responsible for the Content of links to external pages. AMEN will not be responsible for any compensation for the effect of canceling, denying, suspending or denying access to the mobile Applications or Websites. AMEN is not responsible and expressly exempted by the contact or virtual communication between Users, its Content, publication or derived consequences. AMEN makes no warranty that the Services will be available on an uninterrupted, secure, or error-free basis. AMEN makes no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any Content. AMEN will reasonably use the means at its disposal to provide security systems that reasonably protect its development, source code, systems and Information contained there against deliberate attacks, malicious software, malicious hackers, etc. Nevertheless, AMEN does not guarantee the impregnability of its security systems nor the privacy of the Information hosted in them.

9. Validity, Law and Applicable Jurisdiction.

The declaration of nullity or invalidity of any stipulation contained in these terms and conditions, will not affect the validity and effectiveness of the other clauses and conditions. The present terms and conditions will be governed and interpreted by the Colombian Law. Any controversy will be substantiated before the Colombian jurisdiction however the simplest way is to amicably resolve any disagreement before it could arise. If the Terms or our Privacy Policy have any provisions or Information that conflict with other AMEN terms or policies, these Terms and the Privacy Policy as applicable shall govern.

Assignment

AMEN may give its rights, or obligations, under these Terms to any person or entity at any time with or without User consent. User may not give their rights or obligations under these Terms to anyone without first getting AMEN’s written consent, and any attempt to do so without AMEN consent is void. When User uses the Services, directly or indirectly agrees to be bound by these terms and conditions. If User does not agree to all the terms and conditions then User must not use the Services.
